3rd International Scientific and Practical Conference

“Information Technology and Law (Legal Informatization - 2010)”

25 November 2010 the 3rd International Scientific and Practical Conference “Information Technology and Law (Legal Informatization – 2010)” (hereinafter – conference) took place at the National Library of Belarus. The conference was held by the National Center of Legal Information of the Republic of Belarus (hereinafter – NCLI) and the UNESCO Chair in Information Technologies and Law of the NCLI.

The main objective of the conference is to discuss problems and exchange experience in the field of legal informatization and access to official legal information. Within the framework of the conference a wide range of issues were addressed, including such directions as:

  • development and improvement of the state system of legal information of the Republic of Belarus;
  • current problems of improving legislation in the field of legal informatization;
  • domestic and foreign experience of dissemination and the provision of legal information;
  • improvement of linguistic support of databases and databanks of legal information;
  • applied aspects of the use of modern information technologies in legal activities;
  • interstate exchange of legal information.

Deputy Head of the Administration of the President of the Republic of Belarus Valery V. Mitskevich addressed the welcome speech to the participants of the conference and wished them fruitful work.

Those who participated in the conference and made substantial reports are:

representatives of various state bodies and organizations of the Republic of Belarus, including Chairman of the Supreme Economic Court of the Republic of Belarus Viktor S. Kamenkov, first Deputy Minister of Justice of the Republic of Belarus Alexander V. Bileichik;

representatives of several international and foreign organizations, including Deputy Head of the Legal Department of the Secretariat of the EurAsEC Integration Committee Kazibek M. Maldibaev, Director of the Republican State Enterprise “Republican Center of Legal Information” of the Ministry of Justice of the Republic of Kazakhstan Erbol K. Ospanov, Head of Software Development of the Information Systems Department of the Scientific Center of Legal Information at the Ministry of Justice of the Russian Federation Nikolai Y. Blagoveschensky;

researchers, teaching staff of educational institutions;

representatives of the distribution organizations of legal information of Belarus;

specialists in the field of legal informatization from Russia, Kazakhstan, Ukraine, Lithuania, Latvia.

Media coverage of the conference involved leading news agencies and television channels of our country.

The conference allowed participants to exchange views on the use of modern information technologies in the legal sphere in order to build information and legal spaces and ensure equal access to legal information. Major decisions were taken to improve these directions adopted by the participants in the Final Conference Document.

The exhibition, held in conjunction with the work of the conference, provided an opportunity for participants to learn the results of the implementation of information technologies in the legal sphere in our country.

Participants of the 3rd International Scientific and Practical Conference “Information Technology and Law (Legal Informatization – 2010)” held by the National Center of Legal Information of the Republic of Belarus (hereinafter – NCLI) with the assistance of the UNESCO Chair in Information Technologies and Law of the NCLI,

with the participation of scientists and practitioners from Belarus, Kazakhstan, Latvia, Lithuania, Russia, Ukraine,

guided by the Declaration of Principles World Summit on the Information Society and the Universal Declaration of Human Rights,

taking into account international legal documents of the United Nations Organization on education, science and culture, in particular the UNESCO Recommendation concerning the Promotion and Use of Multilingualism and Universal Access to Cyberspace, as well as Guidelines for the Development and Promotion of Government Information in the Public Domain,

aware of the need to consider processes of the development of legal informatization as an integral part of the information society,

having heard and discussed reports and presentations of the participants of the conference,

note:

absolute relevance of problems addressed at the conference and directions of the development of legal informatization, including through international cooperation;

consistent implementation by the NCLI of the decisions passed in 2002 and 2004 International Scientific and Practical Conferences “Modern Computer Technologies in the Systems of Legal Information (Legal Informatization – 2002)” and “Information Technologies and Law (Legal Informatization – 2004)”, as well as achievements in the development of legal informatization in the Republic of Belarus;

presence of progressive trends and effective operation of the state system of legal information created in the Republic of Belarus on the basis of modern information technologies;

effective operation of systems of legal information and legal informatization in the countries whose representatives participated in the conference;

improvement of information and legal support of state bodies of the Republic of Belarus due to the introduction of automated systems and databanks of legal information;

need to:

coordinate with the state for research and staff support of processes of legal informatization in national, regional and interregional programs;

develop further information and legal resources for the state system of legal information of the Republic of Belarus;

create information and legal resources, which provide translations of legal terms into state languages, and the most popular foreign languages;

ensure the accessibility of legal information through the creation and development of a network of public centers of legal information, centers of standard legal information based on the experience of the NCLI using telecommunications systems and technologies, as well as technologies used in creating “e-governments”;

improve the system of information and legal training of non-legal professionals, including through the organization of appropriate educational activities;

organize events (“round tables”) for the exchange of experiences in creating information and legal resources between state bodies and other organizations and the NCLI;

adopt at national and international levels, corresponding legal, organizational, technical and other measures to improve the reliability and security of legal information technologies;

develop further international cooperation in the field of legal informatization and create a single information and legal space within the framework of corresponding interstate associations.

Stressing the importance of issues of legal informatization that were discussed, the participants of the conference state that:

wide application of information technologies in all spheres of human activities, including in the legal sphere, essentially influences world development, creates important preconditions for major economic and social transformations and promotes the formation of information society;

at all stages of legal informatization, special significance is given to processes of legal awareness among citizens, which is one of the priorities for dynamic development of a civilized state;

further realization of effective state information policy and legislation development in the field of legal informatization will help improve access to legal information and information about the activities of state bodies;

information technologies in the legal field should be directed primarily at providing access to legal information for the general population, including minors and persons with disabilities.

The conference identifies and proposes solutions for the development and implementation in practice of state legal information system and technologies for “e-government” in the following priority areas for the development of legal informatization:

development and consistent implementation of scientifically grounded approaches, projects and programs aimed at creating a single information and legal space for each state, and a coordinated information and legal space within the framework for interstate formations;

consistent formation and development of national and regional (interregional) legal information systems, including through the establishment and improvement of databanks of legal information, also containing the decisions of government bodies at all levels, the results of enforcement activities of state bodies, and official translations of normative legal acts, etc.;

improvement of the legislation of states in the field of legal informatization due to determining the institutional and legal basis (principles) of state policy in the field of legal informatization at national levels and the creation of legal information systems based on modern information technologies;

implementation, into national legislation, of the main provisions of the UNESCO Recommendation concerning the Promotion and Use of Multilingualism and Universal Access to Cyberspace, as well as Guidelines for the Development and Promotion of Government Information in the Public Domain, the creation of legal mechanisms to guarantee access to legal information and information on the activities of state bodies;

formation of single conceptual approaches and the development of international cooperation in the training of specialists in the field of legal informatization;

development of a system of interstate exchange of legal information in order to build a single information and legal space.

Participants of the 3rd International Scientific and Practical Conference “Information Technology and Law (Legal Informatization – 2010),” are convinced that the implementation of these priorities of the development of legal informatization will be a significant contribution to the development of information and legal spaces of each state, as well as the information society.
